This policy applies to the processing (use) of any personal data carried out by Evekum d.o.o. (the controller, hereinafter referred to as "Evekum") or carried out on behalf of the controller.

Introduction

Evekum respects your right to privacy and is committed to the highest level of protection for your personal data. Therefore, in providing our services, we are committed to acting in accordance with the laws and regulations that define personal data protection, particularly the applicable Personal Data Protection Act, Article 45a of the Consumer Protection Act, the Electronic Communications Act, and the EU General Data Protection Regulation (GDPR).

Evekum commits to using the collected personal data in accordance with this Privacy Policy and not to sell, lend, or otherwise disclose your personal data to third parties, except in cases defined by law.

Personal data protection procedures

If you provide us with any personal data via the website, email, phone, or otherwise, we will respect your privacy in accordance with the GDPR and applicable legislation. Our data protection policy is as follows:

  • We clearly inform users about how and why their data will be used,
  • We do not rent, sell, or otherwise allow third parties to use your data;
  • We regularly check and update our databases to minimize the number of inaccurate records.

Personal data is stored in digital form. Our IT system is protected by technical and organizational measures to prevent accidental or unlawful destruction, loss, alteration, and unauthorized disclosure or access to your personal data.

What personal data we process

  • Basic contact information (first and last name, gender – for addressing purposes, address, phone number, email);
  • Data on the use of our website (clicks on links, time spent) and data on responses to our emails (we only track anonymized cumulative open and click rates);
  • Data necessary for fulfilling orders and contracts.

Legal grounds for processing personal data

We process your personal data based on the following legal grounds:

  • When necessary to fulfill our legal obligations (e.g., issuing invoices for purchased services or products);
  • When processing is necessary to enter into or perform a contract you have concluded with us or because you requested an offer from us;
  • When you have consented to the processing of your personal data for a specific purpose, and you may withdraw this consent at any time;
  • When we have a legitimate interest to process your personal data.

Purposes of personal data processing

We may use your personal data for one or more of the following purposes:

  • Communicating with you regarding the provision of our services and responding to your inquiries;
  • Entering into contracts and fulfilling obligations arising from such contracts;
  • Marketing communication (sending emails, regular mail, and SMS messages) in accordance with the consents you have provided,
  • Enforcing any legal claims and resolving disputes;
  • Statistical analyses of the sales of our services and products and the use of our website – only anonymized data is used,

All personal data you provide to us will be treated as confidential and used solely for the purposes for which it was provided. If a need arises to process your data for another purpose, we will first ask for your consent.

Voluntary provision of data and consequences of non-provision

Providing personal data is voluntary. You are not obligated to provide personal data, but if you do not, we may not be able to offer certain services or enter into a contract with you. We will indicate which data is essential each time we collect personal data from you.

Who has access to your personal data

We do not share or allow access to your personal data by third parties (outside of Evekum), except those who have signed a written agreement with us to perform certain tasks related to data processing and who are obligated to comply with data protection laws (i.e., data processors). The data processors we share data with include:

  1. Sales consultants for offer preparation,
  2. Email service provider (MailerLite);
  3. Accounting service,
  4. Business partners responsible for product delivery,
  5. Business partners responsible for product servicing and installation.

Data processors may only process personal data according to our instructions and may not use it for their own purposes. They and their employees are committed to maintaining the confidentiality of your personal data. Data processors do not transfer personal data to third countries.

The MailerLite service tracks email delivery success by collecting data on opened messages, link clicks, email clients and browsers, approximate location, IP address, subscriptions and unsubscriptions, and failed email deliveries.

Retention period

We retain personal data processed based on your consent permanently or until you revoke this consent. Data related to issued invoices is stored for 10 years from the date of issue. Data necessary for concluding and fulfilling a contract between you and us is stored for 5 years after the fulfillment of the contract.

We retain information about the services or products you have purchased from us permanently or until we receive your request for data deletion. After the retention period expires, we effectively delete or anonymize the personal data, meaning we process it in such a way that it can no longer be linked to you or attributed to you in any way.

Your rights

We will take all necessary measures to ensure the secure handling of your data, in accordance with this Privacy Policy. You have the right to access the personal data we hold about you and the right to correct or delete your data. You also have the right to restrict the use of your data. Any individual to whom the personal data relates can request at any time that Evekum:

  • allows the correction of inaccurate personal data and the completion of incomplete data,
  • grants the right to erasure of personal data (also known as the “right to be forgotten”), if the conditions under Article 17 of the General Data Protection Regulation are met,
  • grants the right to restriction of processing,
  • grants the right to object to processing,
  • grants the right to data portability and provides the data in a commonly used and machine-readable format or directly transfers it to another controller,
  • grants the right to withdraw consent, where personal data is processed based on consent; the withdrawal of consent does not affect the legality of processing carried out before the withdrawal,
  • provides additional information about the right to lodge a complaint with the competent supervisory authority.

Evekum will also, upon an individual’s request and in accordance with applicable legislation, provide other information related to their personal data being processed.

Procedure for exercising rights

You can submit your requests related to the exercise of rights regarding personal data in written form to the contact address listed at the top of this document under "Data Controller and Contact Information".

For reliable identification purposes when exercising your rights regarding personal data, we may request additional information from you. We may refuse to act only if we can demonstrate that we are unable to reliably identify you.

Evekum commits to responding to such requests without undue delay and no later than 15 days after receiving the request or within the legally prescribed deadlines.

If you no longer wish to receive email newsletters, you can unsubscribe using the automatic unsubscribe link provided in each email, or by sending an email with the content “UNSUBSCRIBE” to: info@prezracevalni-sistemi.com

Privacy policy changes

We reserve the right to modify this Privacy Policy from time to time to reflect actual circumstances and data protection legislation. The valid version of the Privacy Policy is published on our website and displayed on the information board in the Evekum company’s information office.
